Local school districts and charter schools in Delaware have the authority to prescribe rules and policies for the safe and orderly conduct of schools. As a result this may lead to a student being suspended or expelled from school due to conduct that is in violation of the school rules or policies. However, schools cannot just remove a student from his/her regular school program without providing certain due process rights. Make sure that you review your rights and responsibilities by checking the school or district Code of Conduct or Policies and Procedures. If you still have questions, feel free to contact our office at 302-857-3358 for assistance.
