This report describes the results of an annual program data collection conducted to determine:
- (1) The type of educational programs and staff that serve Limited English Proficient (LEP) students in the Delaware public and nonpublic schools, and
- (2) The location and academic conditions of identified LEP students who are eligible for participation in local district programs.
This activity is supported by Delaware's state grant under the Bilingual Education Act, ESEA Title VII, as amended during the FY 98-project year. The LEP student tracking and record documentation was conducted through a computerized LEP management information system (MIS) utilized by the Education Specialist for the bilingual and ESL programs, Department of Education.
Information about Delaware's bilingual or ESL programs was collected through a survey of the district LEP contact person or the professional staff responsible in each school district for managing the local instructional program for LEP students. Delaware public school districts submitted the survey in January 1999 to the Department of Education.
All 22 Delaware public school districts including public charter districts participated in the annual LEP student program survey. A sampling of 33 nonpublic schools received the survey. Of these, 2 schools returned the survey.
Table 1 is a summary of the Delaware public and nonpublic schools' enrollments. Public school enrollment is as of March 1999. Nonpublic enrollment is as of October 1999.
Table 2 contains the type of programs implemented for the district's LEP students. All information was obtained from the Program Survey Form.

The following two tables reflect the estimated hours per day students receive specifically designed instruction to develop the English language proficiency of LEP students. Table 3A contains information for grades K-5, and Table 3B contains information for Grades 6-12. All data was collected using the Program Survey Form.

ESL (English as a Second Language Program): ESL programs of instruction are designed for children of limited English proficiency in elementary and secondary schools with a specifically designed curriculum that is appropriate for the particular linguistic and instructional needs of the children enrolled. Such a program provides in all grades served by the program, structured English language instruction and content area English instruction, which will allow a child to achieve competence in the English language and to meet grade-promotion and graduation requirements.
ESL - Full-time or Part-time: LEP students receive specialized instruction for a portion of the school day or for a significant amount of time during the school day.
ESL Pull-out: There is pullout ESL instruction where students are taken out of a class to be instructed in a small group or receive one-on-one tutoring to improve English language proficiency.
ESOL: English to Speakers of Other Languages.
Exempted Students: LEP students in grades 3, 5, 8, and 10 who would normally take the Delaware State Testing Program, but due to a lack of English proficiency, can be exempted from the state assessment one time only if they have been in a Delaware School less than 2 years.
Charter School District: In Delaware, a charter school has the same basic standing as a public school district, with some exceptions. Delaware had 3 charter school districts during the 1998-1999 school year. They are the Charter School of Wilmington, East Side Charter School and Positive Outcomes Charter School.
Limited English Proficient (LEP): Students who have difficulty speaking, reading, writing, or understanding the English language because they are:
(A) Individuals who were not born in the United States or whose native language is a language other than English; or
(B) Individuals who come from environments where a language other than English is dominant; or
(C) Individuals who are American Indian and Alaskan natives and who come from environments where a language other than English has had a significant impact on their level of English language proficiency; And
(D) By reason thereof, are denied the opportunity to learn successfully in classrooms where the language of instruction is English or to participate fully in our society.
Native Language: The term "native language", when used with reference to an individual of limited English proficiency, means the language other than English normally used by such individuals.
Student's Served: Those LEP students who receive specialized instruction designed to develop the English language proficiency and help them succeed in classrooms where instruction is in English.
Transitional Bilingual Education (TBE): The term "transitional bilingual education" means a program of instruction, designed for children of limited English proficiency in elementary or secondary school which provides, in all grades served by the program, structured English language and instruction, and, to the extent necessary, to allow a child to achieve competence in the English language, instruction in the child's native language. Such instruction shall incorporate the cultural heritage of such children and of other children in American society. Such instruction shall, to the extent necessary, be in all courses or subjects of study, which will allow a child to meet grade-promotion and graduation standards.
Two-Way Bilingual Program (Two-Way): The term "two-way" refers to an integrated program model that provides second language instruction to language minority students and foreign language instruction to English language speakers (language majority students) across all content areas. Both groups of students become fluent in 2 languages.
