Title I School Choice
Under the Elementary and Secondary Education Act, Title I schools must offer public school choice if the schools are:
- in the first year of school improvement, (the second consecutive year of not making adequate yearly progress)
- in the second year of school improvement,
- in corrective action,
- in the planning year for restructuring, or
- in restructuring.
All students enrolled in the Title I schools described above are eligible for choice. Priority must be given to the lowest achieving, low income students. Schools that can receive students must not be identified for improvement, corrective action, or be in the planning year of restructuring or in restructuring; or be identified by the State as persistently dangerous. A public charter school within the LEA can be considered an option. The LEA must offer more than one choice to eligible students.
The LEA is required to notify all parents of students enrolled in Title I schools that have been identified as having to provide choice sufficiently in advance of, but no later than 14 calendar days before, the start of the school year for which public school choice is being offered. This notification must be comprehensive and in an easy-to-understand format. [34 C.F.R. Section 200.37(b)(4)(iv)]
